It stands for The Intellectual Property Society of Yorkshire and it was started by my fellow St Andrean, <a href="https://www.sonderandclay.com/team/andrew-clay/" target="_blank">Andrew Clay</a> of Sonder & Clay, I have mentioned TIPSY twice before in this publication. The first time was when we entertained His Honour Judge Hacon to dinner (see <i><a href="https://ipyorkshire.blogspot.com/2018/12/tipsy.html" target="_blank">TIPSY</a> </i>10 Dec 2018). The second was when we welcomed Mr Justice Birss as he then was just before lockdown (see <a href="https://ipyorkshire.blogspot.com/2020/02/tipsy-dinner-for-mr-justice-birss.html" style="font-style: italic;" target="_blank">TIPSY Dinner for Mr Justice Birss</a><i> </i>28 Feb 2020). I have attended a few more of these dinners but I have not always been inspired to write about them.</p><p>Yesterday's is worth writing about because the guest of honour was<a href="https://8newsquare.co.uk/barrister/justin-turner/" target="_blank"> Justin Turner KC</a>. He spoke to us about Mrs Justice Joanna Smith's decision in <i><a href="https://www.bailii.org/ew/cases/EWHC/Ch/2023/3090.html" target="_blank">Getty Images (US) Inc and others v Stability AI Lt</a>d</i> [2023] EWHC 3090 (Ch) (1 Dec 2023) and the Supreme Court's judgment in <a href="https://www.bailii.org/uk/cases/UKSC/2023/49.html" style="font-style: italic;" target="_blank">Thaler v Comptroller General of Patents, Designs and Trade Marks</a><a href="https://www.bailii.org/uk/cases/UKSC/2023/49.html" style="font-style: italic;"> </a>[2023] UKSC 49 (20 Dec 2023). I have a particular interest in those cases having mentioned both of them in <a href="https://www.linkedin.com/pulse/two-important-decisions-artificial-intelligence-ip-jane-lambert-hopne/?trackingId=ZedkwHW%2FR%2BCKcRmN2Si6rQ%3D%3D" target="_blank">my first newsletter</a>. I wrote about Mrs Justice Joanna Smith's decision in <i><a href="https://nipclaw.blogspot.com/2023/12/copyright-and-artificial-intelligence.html" target="_blank">Copyright and Artificial Intelligence - Getty Images (US) Inc and others v Stability AI Ltd</a> </i>in <i>NIPC Law </i>on 12 Dec 2023 and the Supreme Court's in <i><a href="https://nipclaw.blogspot.com/2023/12/the-supreme-courts-judgment-in-dabus.html" target="_blank">The Supreme Court's Judgment in DABUS</a> </i>on<i> </i>26 Dec 2023 in<i> NIPC Law.</i></p><p>Justin focused on <i>Getty </i>and he produced a number of slides and handouts for the audience, He began his talk by introducing us to <a href="https://en.wikipedia.org/wiki/Candle_problem#:~:text=The%20candle%20problem%20or%20candle,a%20participant's%20problem%20solving%20capabilities." target="_blank">Duncker's problem</a> which Wikipedia describes as "a <a href="https://en.wikipedia.org/wiki/Cognitive_test" target="_blank">cognitive</a> <a href="https://en.wikipedia.org/wiki/Performance_test_(assessment)" target="_blank">performance test</a>, measuring the influence of <a href="https://en.wikipedia.org/wiki/Functional_fixedness" target="_blank">functional fixedness</a> on a participant's <a href="https://en.wikipedia.org/wiki/Problem_solving" target="_blank">problem-solving</a> capabilities." The objective is to fix and light a candle on a corkboard in a way that the candle wax won't drip onto the table below. Each person who takes part is issued with a board, a candle, a box of drawing pins and some matches. </p><p>He also screened an extract from a scientific paper but left it to us to guess its connection with Dubcker's problem, the concept of artificial intelligence and Mrs Justice Joanna Smith's decision not to strike out Getty's case against Stability AI.</p><p>In his discussion on <i>DABUS </i>Justin referred to para [52] of Lord Kitchin's judgment where he said:<br /></p><blockquote>"in this jurisdiction, it is not and has never been Dr Thaler's case that he was the inventor and used DABUS as a highly sophisticated tool. Had he done so, the outcome of these proceedings might well have been different."</blockquote><p>That prompted me to ask the question: "Who is funding this and similar litigation around the world and why?" Neither Justin nor anyone else around the room knew the answer to that conundrum.</p><p>On 31 Jan 2024, I attended an excellent introduction by <a href="https://www.linkedin.com/in/klaire-tanner-89832355/" target="_blank">Klaire Tanner </a>to various artificial intelligence software that is available to the public and was shown what they can do. I used one of those application to make the masthead for the second issue of my newsletter</p><p>Earlier today I was delighted to learn that <a href="https://www.linkedin.com/in/parminder-lally/" target="_blank">Parminder Lally</a> and one of her colleagues have accepted an invitation to speak at the <a href="https://informaconnect.com/ip-law-summer-school/" target="_blank">Cambridge IP Law Summer School </a> She has drafted a lot of specifications for computer-implemented inventions and she knows a great deal about the legal issues relating to AI. She is the author of the <a href="https://www.linkedin.com/newsletters/brain-blog-7009529535486394368/" target="_blank">brAIn blog</a> newsletter. Her presentation last year was excellent. Design Network North is a project delivered by <a href="https://www.rtcnorth.co.uk/" target="_blank">RTC North</a>. According to its website RTC North is "one of Europe’s leading technology transfer companies with a trusted reputation for delivering services in innovation and business growth." Its head office is in Sunderland and it has branches in Leeds and Daresbury.</div><div style="text-align: left;"><br /></div><div>I was introduced to Design Network North when it held a Rise & Design meeting at the <a href="http://www.3mbic.com/" target="_blank">3M Buckley Innovation Centre</a> in Huddersfield on 20 Jan 2017. I wrote about the event in<a href="https://ipyorkshire.blogspot.com/2017/01/rise-design-in-huddersfield.html" target="_blank"> <i>Rise & Design in Huddersfield </i></a>on 21 Jan 2017. Most of its other meetings have taken place in Gateshead or other venues in North East England which is a long way to travel for a morning networking event, </div><div><br /></div><div>However, during lockdown, <a href="https://www.linkedin.com/in/terry-mcstea-22972b4/" target="_blank">Terry McStea</a> Head of Design at Design Network North held formal or informal online discussions for entrepreneurs, designers, makers and their professional advisors almost every week. As I live on my own I was very grateful for those sessions because they helped me to keep in touch with the rest of humanity during that difficult period. I discussed some of those events in <i><a href="https://nipcnortheast.blogspot.com/2020/06/rise-and-design-online-webinar-for.html" target="_blank">Rise and Design Online: A Webinar for Designers in Northeast England on Designing our Way out of Lockdown</a> </i>16 June 2020 <i>IP North East</i>,<a href="https://nipcnortheast.blogspot.com/2020/11/the-impact-of-eu-exit-on-health-and.html" target="_blank"> <i>The Impact of EU Exit on the Health and Life Science Sectors</i></a> 19 Nov 2020, <i>IP North East, <a href="https://nipcnortheast.blogspot.com/2021/03/rise-design-webinar-wearable-tech.html" target="_blank">Rise & Design: Wearable Tech Webinar</a> </i>13 March 2021, <i>IP North East</i> and <i><a href="https://nipcnortheast.blogspot.com/2021/10/the-bright-side-of-death.html" target="_blank">The Bright Side of Death</a> </i>14 Oct 2021, <i>IP North East.</i></div><div><br /></div><div>On 23 Feb 2024, Design Network North held a <i>Rise & Design</i> in the Chapter Hall of the <a href="https://www.northernmonk.com/pages/leeds" target="_blank">Northern Monk</a> brewery in the Old Flax Store of Marshall Mills on Marshall Street in Leeds. The Chapter Hall is at the top of several flights of stairs of a building that does not have a lift, As I am still nursing an injury that I sustained in a ballet workshop nearly 2 years ago I had to work hard and take my time to reach the meeting room. Happily, ample supplies of hot drinks and sausage and bacon rolls rewarded our exertions. I was one of the first to arrive and I made several new acquaintances over those refreshments before the meeting began.</div><div><br /></div><div>Eventually, Terry called us to order and invited us to greet and exchange pleasantries with the person sitting next to us. I met <a href="https://www.linkedin.com/in/sharon-sheard-3320b8267/" target="_blank">Sharon Sheard</a> of Medola Comms on my table. Terry then introduced Design Network North and the day's topic which was <a href="https://www.designnetworknorth.org/events/rise-and-design-the-power-of-innovation/" target="_blank">"The Power of Innovation"</a>. He explained that innovation meant a new way of doing things which could include inventions but the concept was much wider than that. Changing the way we communicate with customers, manage our staff or find new suppliers can also count. Each of the speakers discussed a different aspect of the concept.</div><div><br /></div><div>The first speaker was <a href="https://www.linkedin.com/in/fionaconor/" target="_blank">Fiona Conor</a>, Managing Director of <a href="https://www.trustelectricheating.co.uk/" target="_blank">Trust Electric Heating Ltd</a>. who had been on her feet when I arrived at the UK RI's <a href="https://iuk.ktn-uk.org/programme/innovate-local/" target="_blank">Innovate Local</a> event at Dean Clough Mills on 14 Nov 2023 (see <i><a href="https://ipyorkshire.blogspot.com/2023/11/innovate-local-visits-halifax.html" target="_blank">Innovate Local Visits Halifax</a> </i>29 Nov 2023). Mrs Conor's husband had invented a wall-mountable electric heater for which their company had sought a <a href="https://patentimages.storage.googleapis.com/79/50/d0/6dfc577173a025/EP3769016B1.pdf" target="_blank">European patent</a>. Apparently, the initial design had been unpatentable but Mr Conor introduced some refinements which satisfied the examiners. The speaker also told us that part of the development work had been undertaken by a university with Knowledge Transfer Exchange funding. There was a short debate on the merits of collaboration between businesses and universities in Mrs Conor's Q&A in which I participated.</div><div><br /></div><div>The second speaker was <a href="https://www.linkedin.com/in/darrenengine/" target="_blank">Darren Evans</a> of the <a href="https://engineroomdesign.com/" target="_blank">Engine Room</a> whom I first met when the consultancy was based in the <a href="https://www.themediacentre.org/" target="_blank">Huddersfield Media Centre</a>. Mr Evans is an engaging speaker whose abiding message was that one's brand is one's business and <i>vice versa. </i>He discussed the case history of <a href="https://engineroomdesign.com/our-work/paxman-scalp-cooling/" target="_blank">Paxman Coolers Ltd</a>. which has developed a device to cool chemotherapy patients' scalps thereby preventing or reducing hair loss. I remembered that that device had been featured at the Rise & Design meeting in Huddersfield just over 7 years ago. I remarked in the Q&A that it had been impressive then and was even more interesting now.</div><div><br /></div><div>The last speaker was <a href="https://www.linkedin.com/in/richardnhall/" target="_blank">Richard Hall</a> of <a href="https://www.pd-m.com/" target="_blank">pd-m</a> who is a product design consultant. I have known him for many years and have chaired many meetings at which he has been the guest speaker and also shared platforms with him on more than one occasion. He had been one of the speakers at the Rise & Design meeting in Huddersfield in 2017. He always has something interesting to say and I think it was the opportunity to hear his presentation that attracted me to that Rise & Design meeting in Huddersfield. Last Friday's event was the first time we had met since lockdown. pdM has grown over the years and has taken on new staff. Most of its work is in the medical devices sector. </div><div><br /></div><div>After the talks, I gave a short pitch for the Initial Advice and Signposting service that I am relaunching from the Barnsley Business Village (see <i><a href="https://ipyorkshire.blogspot.com/2024/02/relaunch-of-barnsley-ip-clinic.html" target="_blank">Relaunch of the Barnsley IP Clinic</a> </i>16 Feb 2024) and promoting the IPEC Small Claims Track in Leeds (see <i><a href="https://ipyorkshire.blogspot.com/2024/02/bringing-or-defending-small-ip-claim-in.html" target="_blank">Bringing or Defending a Small IP Claim in Leeds</a> </i>8 Feb 2024). Incidentally, I have offered an Iittial Advice and Signposting service in the North East as well as Yorkshire since 2020 (see <i><a href="https://nipcnortheast.blogspot.com/2020/05/initial-advice-and-signposting-in-north.html" target="_blank">Initial Advice and Signposting in North East England</a> </i>24 May 2020 <i>IP North East</i>) and its has been possible to bring small IP claims in Newcastle upon Tyne as well as Leeds for several years (see <i><a href="https://nipcnortheast.blogspot.com/2019/07/small-claims-track-ip-litigation-in.html" target="_blank">Small Claims Track IP Litigation in Newcastle upon Tyne</a> </i>19 July 2019 <i>IP North Easr.</i></div><br />Both the Yorkshire and the North East England initial advice and signposting schemes operate on a triage basis. If, for example, it appears that a client needs to see a patent attorney I will try to make a free 30-minute appointment with one which can take place by phone, Zoom or in the attorney's office. One of the new connections that I made on Friday was with <a href="https://www.linkedin.com/in/greg-carty-hornsby-5a92641b/" target="_blank">Greg Carty-Hornsby</a> of Marks & Clerk. He also gave a short presentation immediately after me and he has kindly agreed to give users of our initial advice and safeguarding service who need to meet a patent attorney up to 30 minutes of his time.<br /><br />The last presenter was <a href="https://www.linkedin.com/in/ian-barber/" target="_blank">Ian Barber</a> of IT consultancy <a href="https://reachaware.com/" target="_blank">Reach Aware Ltd</a> which offers IT support and outsourcing.<div><br /></div><div>Terry announced that the next Rise & Design meeting will take place in Newcastle. I continued to offer those consultations over Zoom during lockdown and afterwards (see <a href="https://ipyorkshire.blogspot.com/2023/03/ip-clinic-faqs.html" target="_blank">IP Clinics FAQs</a> 8 March 2023 <i>IP Yorkshire)</i>. Even though a consultation could take place at almost any time they were never as popular as the drop-in clinic. It was intended to supplement <a href="https://www.judiciary.uk/wp-content/uploads/JCO/Documents/CJC/Publications/Other+papers/Small+Claims+Guide+for+web+FINAL.pdf" target="_blank"><i>A Guide to Bringing and Defending a Small Claim</i> </a>by the Civil Justice Council and A <i>Guide to the Patents County Court Small Claims Track</i> which has been replaced by the <i><a href="https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/1168622/ipec-sdt-guidance-july-2023.pdf" target="_blank">Guide to the Intellectual Property Enterprise Court Small Claims Track</a> </i>("the Guide").</p><p>Much of that article remains true though there have been a number of developments since then. The UK has left the European Union which means that IPEC is no longer a Community designs or EU trade mark court. Disputes over unregistered Community designs or EU trade marks that have arisen since 31 Dec 2020 are no longer within the IPEC Small Claims Track's jurisdiction. The Leeds District Registry and the District Registries of several other major cities have been integrated with the courts in the Rolls Building in London to establish the Business and Property Courts (see my article <i><a href="https://ipnorthwest.blogspot.com/2017/07/launch-of-judicial-super-highway.html" target="_blank">Launch of a Judicial Super Highway?</a> </i>12 July 2017 <i>IP Northwest</i>). As a consequence of that integration it has been possible to bring certain types of small intellectual property claims in Leeds for most of the last 5 years (see Jane Lambert <i><a href="https://ipyorkshire.blogspot.com/2019/07/small-claims-track-ip-litigation-in.html" target="_blank">Small Claims Track IP Litigation in Leeds</a> </i>10 July 2019). According to Annex A of the Guide small IP claims in Leeds come before District Judge Prest KC. Since 3 July 2023 most small IP claims litigation has been conducted in the North because Manchester Civil Justice Centre is now the new home of the IPEC Small Claims Track (see Jane Lambert <i><a href="https://ipnorthwest.blogspot.com/2023/06/ipec-small-claims-to-be-case-managed-in.html" target="_blank">IPEC Small Claims to be managed in Manchester</a> </i>9 June 2023 <i>IP Northwest</i>).</p><p>The sections of <i>How to Bring or Defend a Small Intellectual Property Claim in the Intellectual Property Enterprise Court </i>that continue to apply are those headed "Do you need a Lawyer?" and "Have you got a Case?" In addition to the pro bono services listed in section 6 of the Guide, I would add I<a href="https://www.ipprobono.org.uk/" target="_blank">P Pro Bono</a> which is now part of <a href="https://www.lawworks.org.uk/" target="_blank">Lawworks</a>, <a href="https://thelegaleducationfoundation.org/grantee/advocate" target="_blank">Advocate</a> which was formerly known as "Bar Pro Bono" and my own <a href="https://ipyorkshire.blogspot.com/2017/11/initial-advice-and-signposting.html" target="_blank">"Initial Advice and Signposting"</a> clinic which I run in conjunction with Barnsley Business Village. </p><p>It is still necessary for claimants to write a "letter before claim" unless there are very good reasons not to do so but the practice direction referred to in the section headed "Pre-Action Correspondence" has been revoked and replaced with the <a href="https://www.justice.gov.uk/courts/procedure-rules/civil/rules/pd_pre-action_conduct" target="_blank">Practice Direction - Pre-Action Conduct and Protocols</a> (see my article <i><a href="https://nipclaw.blogspot.com/2015/05/what-to-do-about-new-practice-direction.html" target="_blank">What to do about the new Practice Direction - Pre-Action Conduct</a> </i>6 May 2015 <i>NIPC Law). </i>Guidance on the steps to be taken by parties to intellectual property disputes is no to be found in <a href="https://www.justice.gov.uk/courts/procedure-rules/civil/rules/pd_pre-action_conduct#6.1" target="_blank">para 6 </a>of the Practice Direction.<br /><br />The first paragraph of the section headed "Starting the Claim" has to be modified since the Manchester Civil Justice Centre and not the Rolls Building is now the home of the IPEC Small Claims Track and a small IP claim can now be issued out of the Business and Property Courts in Birmingham, Bristol, Cardiff, Liverpool, Manchester and Newcastle as well as Leeds. It consists of 9 bodies one of which is <a href="https://iuk.ktn-uk.org/" target="_blank">Innovate UK</a>. Innovate UK is the national innovation agency. It helps businesses grow through the development and commercialisation of new products, processes, and services, </p><p><a href="https://iuk.ktn-uk.org/programme/innovate-local/" target="_blank">Innovate Loca</a>l promotes UKRI and Innovate UK to the regions. On 14 Nov 2023, it held an event for West Yorkshire businesses at <a href="https://web-eur.cvent.com/event/8f391b17-d89f-4d0c-acf2-89f084923d4a/summary?dm_i=2VFU%2C1FFC4%2C8A0LQO%2C5NEWI%2C1&utm_campaign=Innovate%20Local%20West%20Yorkshire%2002_2399332&utm_medium=email&utm_source=dotdigital" target="_blank">Dean Clough Mill</a>s in Halifax, The day began with introductions from UKRI and Innovate UK executives, Tracy Brabin, the Mayor of West Yorkshire, and other local authority leaders. It was followed by success stories from business owners.<br /><br />A buffet lunch was served between 12:00 and 13:00 which offered a chance to visit the stands of local universities and agencies. The University of Huddersfield stand was staffed by <a href="https://pure.hud.ac.uk/en/persons/john-allport" target="_blank">Prof. John Allport</a> who teaches Turbocharger Engineering in the Department of Engineering and Technology. Prof Allport and I had an interesting discussion on why relatively few women make careers in engineering. In his view, too many girls (but not boys) are encouraged to believe at an early age that maths and science are not really for them. Other countries do not seem to have that problem to anything like the same extent. That accorded with my experience. It may have a lot to do with very early specialization in England and Wales.</p><p>After lunch there was a choice of breakout sessions between 13:00 and 14:00:<br /></p><ul style="text-align: left;"><li>"Inclusive Innovation - by and for everyone"</li><li>"Healthcare Innovation: funding and cluster opportunities" and </li><li>"Supporting your Business Innovation Journey."</li></ul><div>I chose "Healthcare Innovation! in the hope of hearing about such initiatives as <a href="https://www.cvent.com/venues/bradford/educational-facility/institute-of-pharmaceutical-innovation-at-university-of-bradford/venue-95e70102-c1c8-4187-926a-06873c01dfd4" target="_blank">Bradford University's Institute of Pharmaceutical innovation</a>. There was plenty of information about the biomedical catalyst and support for SMEs in the healthcare technology sector. There was an interesting case history from one of those companies. There was some discussion about medical devices but nothing on pharma as such. However, I did learn that the <a href="https://www.westyorks-ca.gov.uk/" target="_blank">West Yorkshore Combined Authority</a> had an interest in <a href="https://www.westyorks-ca.gov.uk/projects/growing-business/healthtech/" target="_blank">health tech</a>. Through exploring its web pages on health tech I discovered a five year <i><a href="https://www.westyorks-ca.gov.uk/media/8045/healthtech-strategy-2022-2027.pdf" target="_blank">Healthtech Strategy</a></i> for the region.<br /><br />Between 14:00 and 15:00 the choice lay between:</div><div><ul style="text-align: left;"><li>"West Yorkshire Manufacturing Cluster"</li><li>"Women in Digital Innovation Network" and </li><li>"Financing your Business Innovation Journey."</li></ul><div>I attended the financing session and found it was the most interesting of the day. There was a panel of angels and venture capitalists chaired by Basit Mohammed, Knowledge Transfer Manager ‑ Regional Investments Innovate UK KTN. There was one entrepreneur who had actually started a business and it was interesting to see the tangible support that was actually available. As most of the seats had been taken by the time I arrived I found myself an excellent heckling position at the back of the room. I asked about valuation of start-ups when their only assets were a patent application at best. I was looking to the private equity investors and I did not really get a clear answer about any of that. I also asked the VCs about flotations on the <a href="https://en.wikipedia.org/wiki/Alternative_Investment_Market" target="_blank">Alternative Investment Market </a> for successful scale-ups. I got the impression that it was still early days.<br /><br />This is trhe second Innovate Local event that I have attended, I was at a similar event in Bradford last year (see <i><a href="https://ipyorkshire.blogspot.com/2022/10/innovate-local-west-yorkshire.html" target="_blank">Innovate Local West Yorkshire</a> </i>22 Oct 2022). According to the <i>Eventbrite </i>card "an opportunity to meet and network with fellow entrepreneurs and discuss the challenges and the advantages of women in business."</p><p>Sadly, I won't be at the Leeds event because I shall be on my way to Anglesey to chair the <a href="https://nipcwales.blogspot.com/2023/04/m-sparcs-world-ip-day-seminar-whom-you.html" target="_blank">Menai Science Park's World IP Day Seminar</a> as part of Wales's celebrations of World IP Day. That event starts at 12:30 which is half an hour after the event in Leeds is due to finish and it will take place online as well as in front of a live audience at the science park. The discussion is likely to focus on trade marks, database rights, trade secrets, copyright and maybe even patents. During the pandemic, I transferred these online which enabled me to talk to clients at any mutually convenient time. That was entirely satisfactory in most instances but there were a few cases when it would have been helpful to have met the client in person. </div><div><br /></div><div>I can now do that under arrangements that I have just agreed with the management of the Business Village (see <i><a href="https://www.business-village.co.uk/event/virtual-ip-clinic-with-jane-lambert-ip-barrister-9/" target="_blank">Virtual IP Clinic with Jane Lambert – IP Barrister</a> </i>on the Business Village's website). As it is over 3 years since I last held a clinic in Barnsley I thought it would be useful to remind those who could benefit from the service with these Frequently Asked Questions.</div><div style="text-align: left;"><b><br /></b></div><div style="text-align: left;"><b>1. What exactly is an IP Clinic?</b></div><div style="text-align: left;"><b><br /></b></div><div style="text-align: left;">An IP clinic is a free consultation with an expert in <a href="https://nipclaw.blogspot.com/p/intellectual-property.html" target="_blank">intellectual property law</a>, Such an expert may be a patent or trade mark attorney or a solicitor or barrister specializing in IP. Members of those professions have different training and do different jobs but we all have similarly detailed knowledge of IP law. <br /><br />Consultations with me are very much like telephone or Zoom conferences or conferences in chambers except that they are free and limited to approximately 30 minutes. That is usually long enough to dispose of most enquiries but if not I will refer the clients to other professionals (who may also offer a free 30-minute consultation) or other sources of information.</div><div style="text-align: left;"><br /></div><div style="text-align: left;"><b>2. What sort of Questions are you asked?</b></div><div style="text-align: left;"> </div><div style="text-align: left;">All sorts.</div><div style="text-align: left;"><br /></div><div style="text-align: left;">I think the most common is when an entrepreneur is thinking of starting a new business and needs to know the sort of steps he or she should take to protect the business from copycats and avoid disputes with established businesses. I advise on confidentiality agreements, trade mark registration, copyright in trade literature, and if there is a new product, options on patenting and design registration I warn against disclosing trade and business secrets, copying other businesses' Ts and Cs and photos and identify other professionals who can assist further. </div><div style="text-align: left;"><br /></div><div style="text-align: left;">Another very common question is about who owns IP resulting from collaboration with others such as product design consultants, universities or just friends and family. I can usually point to template agreements such as the <a href="https://www.gov.uk/guidance/university-and-business-collaboration-agreements-lambert-toolkit" target="_blank">Lambert Toolkit</a> which offer workable solutions.</div><div style="text-align: left;"><br /></div><div style="text-align: left;">Often I am asked to help when an application for a trade mark, registered design or patent has gone wrong. That typically occurs when a business owner or inventor has decided not to instruct a patent or trade mark attorney. Usually, it is possible to save the application but sometimes the best advice is to consult an attorney and start again. </div><div style="text-align: left;"><br /></div><div style="text-align: left;">Occasionally, a client comes to me with a court order or letter before action and several ring binders of evidence and asks what can be done about it. I can usually advise on immediate steps to prevent the situation from getting worse and suggest a way forward for resolving the dispute in the medium term.</div><div style="text-align: left;"><br /></div><div style="text-align: left;"><b>3. Do I have to live in Barnsley to consult you?</b></div><div style="text-align: left;"><b><br /></b></div><div style="text-align: left;">No! It is a celebration of the ingenuity and enterprise of the millions who live or work in that metropolitan county. Here is a <a href="https://www.wyinnovationfestival.com/_files/ugd/15cdc6_840b1d042517411ea551d4c9f80bbd6d.pdf" target="_blank">programme of the events </a>that have been taking place during this Festival.</div><div><br /></div><div>I spent yesterday at <a href="https://web-eur.cvent.com/event/303688a3-3135-4114-90ff-73f603350f43/summary" target="_blank">Innovate Local West Yorkshire</a> which took place at the Great Victoria Hotel in Bradford. I<a href="https://www.ukri.org/councils/innovate-uk/?_ga=2.45797799.2019757882.1665126898-719041667.1650375367" target="_blank">nnovateUK</a> is the national innovation agency. It supports business-led innovation in all sectors and technologies. The event, which was staged in collaboration with the <a href="https://www.westyorks-ca.gov.uk/" target="_blank">West Yorkshire Combined Authority</a> and the <a href="https://www.the-lep.com/business-support/growth-support/connecting-innovation/west-yorkshire-innovation-network/" target="_blank">West Yorkshire Innovation Network</a>, consisted of <a href="https://web-eur.cvent.com/event/303688a3-3135-4114-90ff-73f603350f43/websitePage:0c244e61-58f6-4b7f-b27d-a5ae29dd8707" target="_blank">an all-day conference</a> of <a href="https://web-eur.cvent.com/event/303688a3-3135-4114-90ff-73f603350f43/websitePage:a1803656-7492-42c6-8bad-8f404fed279b" target="_blank">local political and business leaders and academics</a> and an <a href="https://web-eur.cvent.com/event/303688a3-3135-4114-90ff-73f603350f43/websitePage:8a93739c-8b80-4e92-88aa-02d30e223a46" target="_blank">exhibition</a>.</div><div><br /></div><div>The conference was divided into a plenary session in the morning and parallel workshops in the afternoon. There were breaks for morning coffee, lunch and afternoon tea. After a welcome from the leader of Bradford City Council, the Chief Executive of Innovate UK and the Mayor of West Yorkshire there was a panel discussion on what is meant by innovation and related topics. That was generally platitudinous but I welcomed Kamran Rashid's call to think regionally rather than globally. I also noted Mark Roberts's assertion that Yorkshire had the fastest-growing digital sector outside London.</div><div><br /></div><div> After coffee, we heard from various entrepreneurs and academics. I was particularly impressed with <a href="https://www.linkedin.com/in/saile-villegas-327365bb/" target="_blank">Saille Villegas </a>who had come to Leeds from Mexico to study computing and stayed to set up the medical technology company <a href="https://www.seeai.co.uk/" target="_blank">SEEAI Ltd</a>. Having recently read Laura Esquivel's <i>Like Water for Chocolate </i>and having watched the film and ballet of the same name I have developed an interest in Mexico. I had hoped to buttonhole her to find out why she was drawn to this country rather than the United States which is just across the border and has a<a href="https://ustr.gov/usmca" target="_blank"> free trade agreement</a> with her government and Canada but I could not find her in the crowd.</div><div><br /></div><div>Another impressive presentation was on <a href="https://www.ampi.org.uk/" target="_blank">AMPI (the Advanced Machinery and Productivity Institute).</a> This is a collaboration between the National Physical Laboratory, Rochdale Development Agency, the Universities of Huddersfield, Leeds, Manchester and Salford and other organizations to create new machines and technology to manufacture products and materials for the future. The Institute, which is based in Rochdale, carries out research. consultancy, teaching and training. The presenter, whose name I did not catch, reminded the audience that manufacturing is still important to the British economy,</div><div><br /></div><div>Yet another memorable talk was given by <a href="https://www.linkedin.com/in/ian-laidler-bb149411/?originalSubdomain=uk" target="_blank">Ian Laidle</a>r of Wayland Additive which develops IP-rich technologies. Dr Laidler said that the company held 10 patent families and that a further 4 were on their way. I have to say in passing that I was surprised not to meet any other IP lawyers or patent or trade mark attorneys even though IP is key to safeguarding investment in innovation. Dr Laidler explained the advantages of his company's inventions. He finished by speaking about the age range of its employees ranging from gap-year students to pensioners. All had contributed to the company's success.</div><div><br /></div><div>The workshops that I attended in the afternoon were on space and healthcare. Mandy Ridyard of <a href="https://spacehubyorkshire.org/" target="_blank">Space Hub Yorkshire</a> profiled the Yorkshire space industry and discussed the opportunities that I had mentioned in <i><a href="https://nipclaw.blogspot.com/2018/04/commercial-exploitation-of-space-space.html" target="_blank">Commercial Exploitation of Space: Space Industry Act 2019</a> </i>in<i> NIPC Law </i>on 10 April 2018. She mentioned some of the facilities for space research and collaboration that are available at <a href="https://nexusleeds.co.uk/" target="_blank">NEXUS Leeds.</a> She was disappointed that Yorkshire was the only region that had yet to receive inward investment. In the Q&A that followed her talk, I ventured to suggest that might be because most of the new investment in space in this country was directed to launch technology. Yorkshire does not have a spaceport but Harlech which is a 2-hour drive away does. I told her about the Menai Science Park's <a href="https://nipcwales.blogspot.com/2022/04/world-ip-day-celebrating-enterprise.html" target="_blank">webinar to celebrate World Intellectual Property Day</a> and suggested that she should talk to <a href="https://www.linkedin.com/in/emily-roberts-b101478b/?originalSubdomain=uk" target="_blank">Emily Roberts</a> of the science park and <a href="https://www.linkedin.com/in/david-young-0b083b131/?originalSubdomain=uk" target="_blank">David Young</a> of the Snowdonia Aerospace Centre. The other main speaker on space was Emma Hatton of the Satellite Catapult.</div><div><br /></div><div>We learned more about NEXUS in the healthcare workshop and the accelerator programme for the businesses that wished to supply the NHS. Next came <a href="https://www.bradford.ac.uk/staff/lbreen" target="_blank">Professor Liz Breen</a> of the School of Pharmacy and Medical Sciences at the University of Bradford. Prof Breen discussed the <a href="https://www.bradford.ac.uk/dhez/" target="_blank">Digital Health Enterprise Zon</a>e of which she is the Director.</div><div><br /></div><div>The last session was on private funding. We heard from <a href="https://www.linkedin.com/in/jordan-dargue-59438433/?originalSubdomain=uk" target="_blank">Jordan Dargue</a> who had recently set up a network of women business angels to fund women entrepreneurs in the North of England, <a href="https://www.linkedin.com/in/william-schaffer-14318613/" target="_blank">Willian Schaffer</a> of Mercia Asset Management and Sophie Dale-Black of the British Business Bank. I asked Mr Schaffer how many of his companies achieved a flotation on the AIM or were acquired at a premium. He replied that out of every 10 companies, 2 to 3 might fail altogether, another 2 to 3 might return the investment, yet another 2 to 3 might earn a small return and perhaps 1 or 2 might be "unicorns." The skills of the craftsmen who erected and decorated those places of worship are as much in demand at present as they were when those buildings were constructed. </p><p>An initiative to keep those skills alive is <a href="https://yorkminster.org/discover/centre-of-excellence-for-heritage-craft-skills-and-estate-management/" target="_blank">The Centre of Excellence for Heritage Craft Skills and Estate Management</a> which will establish a campus for research, education and training in stonemasonry, glass painting and setting, joinery and other traditional skills. The Centre of Excellence will comprise a <a href="https://yorkminster.org/discover/centre-of-excellence-for-heritage-craft-skills-and-estate-management/a-world-class-campus-facility/" target="_blank">Heritage Quad</a> and a Works and Technology Hub. The Minster has published a video on Youtube which offers a virtual tour of the campus. According to Miran Rahman, the City Council has now approved plans for the new construction (see <i><a href="https://www.thebusinessdesk.com/yorkshire/news/2098806-york-minster-centre-of-excellence-plans-win-approval?utm_source=newsletter&utm_medium=email&utm_campaign=Yorkshire_5th_Sep_2022_Daily" target="_blank">York Minster Centre of Excellence plans win approval</a> </i>2 Sept 2022 TheBusinessDesk).</p><p>None of the announcements in the press or on the Minster's website mentions intellectual property but at least some of the works of the craftsmen and women at the Centre of Excellence are likely to generate or be capable of generating substantial. Most of the works will be works of artistic craftsmanship within the meaning of s.4 (1) (c) of the <a href="https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/957583/Copyright-designs-and-patents-act-1988.pdf" target="_blank">Copyright, Designs and Patents Act 1988</a>. The Centre and Quad are likely to acquire goodwill which can best be protected by trade mark registration. There will be plenty of trade secrets and possibly even some inventions at the Works and Technology Hub.</p><p>Like most research and teaching institutions the Centre is likely to develop an IP policy if it has not already done so. In many cases, the works of those craftsmen and women will belong to their employers but in some instances, it will be theirs to exploit. Happily, there are a lot of patent and trade mark agencies and specialist IP lawyers in York. Sharman is a Yorkshire woman, born and educated in Sheffield, who seized her opportunity to go into space with both hands. <br /><br />On Wednesday, 11 May 2022 the <a href="https://www.the-lep.com/business-support/partners/leeds-city-region-supply-chain-programme/" target="_blank">Leeds City Region Supply Chaim Programme</a> and <a href="https://spacehubyorkshire.org/" target="_blank">Space Hub Yorkshire</a> will hold what they describe as "an event" at the <a href="https://3mbic.com/" target="_blank">3M Buckley Innovation Centre</a> in Huddersfield on <a href="https://www.eventbrite.co.uk/e/opportunities-for-manufacturers-in-the-space-sector-how-to-guide-tickets-313264010087" target="_blank">Opportunities for Manufacturers in the Space Sector - How To Guide</a>, According to the Eventbrite card,</p><blockquote>"[the] event will comprise of a number of engaging talks giving an academic, business and legal focus on how you can grasp these opportunities, as well as a case study of a business that is already working successfully in the space sector. There will also be several exhibitors from partner organisations who will be on hand should you wish to have a chat with them."</blockquote><p></p><p>The event (which is free) will start at 09:15 and end at 13:00.<br /><br />The reason I mention that event is that the space industry is one of the few sectors of the British economy that are likely to grow over the next few years notwithstanding Brexit, covid, inflation and the Russian invasion of Ukraine. That is because world demand for space related products and services is growing. As I said in <i><a href="https://nipclaw.blogspot.com/2018/04/commercial-exploitation-of-space-space.html" target="_blank">Commercial Exploitation of Space: Space Industry Act 2018</a> </i>(10 April 2018 <i>NIPC Law</i>):</p><blockquote>"The value of the global space market is between £155 and £190 billion and likely to rise to £400 billion by 2030 according to the <a href="https://www.parliament.uk/documents/commons-committees/Exiting-the-European-Union/17-19/Sectoral%20Analyses/34-Space-Report.pdf" target="_blank">Space Sector Report 1</a> which was prepared for the House of Commons Committee on Exiting the European Union. The <a href="https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/664563/industrial-strategy-white-paper-web-ready-version.pdf" target="_blank">Industrial Strategy white paper</a> states that the United Kingdom has about 6.5% of that market and that the government hopes to increase that share to 10% by 2030."</blockquote><p>According to the <a href="https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/1034313/national-space-strategy.pdf" target="_blank">HM Government's </a><i><a href="https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/1034313/national-space-strategy.pdf" target="_blank">National Space Strategy</a> </i>which was published last September, these figures remain on track.<br /><br />One of the reasons why the government expects the British share of the space market to grow rapidly is that the United Kingdom is developing a satellite launch capability as I noted in <i><a href="https://nipclaw.blogspot.com/2018/04/space-industry-licensing-spaceports.html" target="_blank">Space Industry - Licensing Spaceports</a> </i>on 11 April 2018 in <i>NIPC Law. </i>So far, the government has licensed space ports in Scotland, Cornwall and North Wales. The nearest to this region is <a href="https://spaceflightacademy.co.uk/snowdonia-spaceport/" target="_blank">Spaceport Snowdonia</a> at Llanbedr near Harlech which I discussed in <i><a href="https://nipcwales.blogspot.com/2022/04/it-is-about-rocket-science.html" target="_blank">It is about Rocket Science</a> </i>on 21 April 2022 and <i><a href="https://nipcwales.blogspot.com/2021/12/the-space-industry-in-wales.html" target="_blank">The Space Industry in Wales</a> </i>on 27 Dec 2021 in <i>NIPC Wales.</i></p><p>The expansion of the UK space industry will give rise to many issues over contracts, funding, liability for damage to property on earth and in space from debris and my own speciality intellectual property. It would appear from Helen Pidd's article <i><a href="https://www.theguardian.com/uk-news/2021/nov/19/government-planning-to-put-hs2-on-stilts-through-manchester" target="_blank">Government planning ‘to put HS2 on stilts through Manchester’</a> </i>in The Guardian on 19 Nov 2021 that even the western spur is to be constructed on the cheap. The reason for the announcements is that the current government regards the Northern Powerhouse project as an exercise in regional development, not unlike similar projects of the last 100 years, rather than the construction of a conurbation of 6 million people to serve as a vibrant industrial, commercial and cultural counterweight to London.<br /><br />As I said in Northern Powerhouse in 2017:<br /></p><blockquote>"The Northern Powerhouse was conceived in the days of the Coalition by the former Deputy Prime Minister, Nick Clegg, and the former Chancellor, George Osborne, as a strategy to stimulate economic growth in the North of England by developing the principal cities of the North of England into a counterweight to London through improving transport links and investing heavily in science, technology, the arts and education (see the speech by the Rt Hon George Osborne <a href="https://www.gov.uk/government/speeches/chancellor-we-need-a-northern-powerhouse" target="_blank">“<i>We need a Northern powerhouse</i>”</a> 23 June 2014)."</blockquote><p>I added:<br /></p><blockquote>"Sadly, the present Chancellor, Philip Hammond, lacked his predecessor’s vision. His <a href="https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/571562/NPH_strategy_web.pdf" target="_blank"><i>Northern Powerhouse Strategy</i></a> has diluted and downgraded the idea of an integrated Liverpool to Leeds conurbation as a viable counterweight to London to a general regional development programme like many others before it for the area north of the Humber and Mersey to the Scottish border."</blockquote><p>Hammond has been replaced by Sunak but his vision appears to be just as limited. </p>In more than one sense, the Northern Powerhouse is a casualty of Brexit. Osborne literally as he was removed from his post by May. Clegg lost his seat the year before the referendum but it was pressure for a referendum that swept the Tories back to power with a sufficient majority to govern alone. However, maybe the idea of a mega-city in the North of England makes less sense when the domestic market suddenly shrinks from 510 million to 67 million.<br /><br />Before Brexit maps of Britain showed the spurs of HS2 extending from Manchester to Glasgow in the west and from Leeds to Newcastle and Edinburgh in the east but what is the point if Scotland secedes? First, it has today published in conjunction with the University of Huddersfield, <a href="https://www.kirklees.gov.uk/beta/default.aspx" target="_blank">Kirklees Council </a>and the <a href="https://www.examinerlive.co.uk/" target="_blank">Huddersfield Examiner</a> a list of the <a href="https://www.hud.ac.uk/media/assets/document/businessschool/kirkleestop100/KirkleesTop100Companies2021-2022reduced.pdf" target="_blank">top 100 companies</a> in the metropolitan borough of Kirklees. Secondly, <a href="https://www.westyorks-ca.gov.uk/a-mayoral-combined-authority/" target="_blank">Tracy Brabin,</a> the recently elected Mayor of West Yorkshire visited the centre to discuss ways of promoting innovation in the borough.</p><p>Kirklees covers a large area stretching from the Leeds suburbs to the Pennines. It combines the former mill towns of Batley, Dewsbury and Huddersfield with rural communities such as the Holme Valley, Meltham and Denby Dale. Its population is estimated to be just under 440.000. For many years those communities were dependent on mining and manufacturing. Those industries have largely disappeared and been replaced by the diverse range appearing in the list of the top 100 companies.<br /></p><p>The 3M Bucjkey Innovation Centre offers <a href="https://3mbic.com/innovation-technology-3m-buckley-innovation-centre/design/" target="_blank">design,</a> <a href="https://3mbic.com/innovation-technology-3m-buckley-innovation-centre/prototyping/" target="_blank">prototyping,</a> <a href="https://3mbic.com/innovation-technology-3m-buckley-innovation-centre/verification-inspection/" target="_blank">verification and inspection services</a>. On 19 Feb 2021, I was invited to discuss those provisions and their implementation to the <a href="https://www.barnsleybic.co.uk/" target="_blank">Barnsley Business Village.</a></div><div style="margin-bottom: 5px;"><br /></div><div style="margin-bottom: 5px;">Many businesses applied for EU trade marks or registered Community designs rather than UK ones because they offered protection in 28 member states and not just one. Those rights ceased to apply to the UK at 23:00 on 31 Dec 2020 when the transition or implementation period provided by art 126 of the withdrawal agreement expired but they remain in force in the 27 member states. However, owners of EU trade marks should be aware that their registrations may be revoked under art 58 (1) (a) of the <a href="https://eur-lex.europa.eu/legal-content/EN/TXT/?qid=1506417891296&uri=CELEX:32017R1001" target="_blank">EU trade mark regulation</a> "if, within a continuous period of five years, the trade mark has not been put to genuine use in the Union in connection with the goods or services in respect of which it is registered, and there are no proper reasons for non-use." </div><div style="margin-bottom: 5px;"><br /></div><div style="margin-bottom: 5px;">Art 54 (1) of the withdrawal agreement entitles the owner of an EU trade mark, registered Community design or Community plant variety to a comparable British trade mark, registered design or plant breeder's right without a fee or any fuss unless he or she opts out of that right. <a href="https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/957352/unofficial-trade-marks-act-1994.pdf" target="_blank">The Trade Marks Act 1994</a>, <a href="https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/957352/unofficial-trade-marks-act-1994.pdf" target="_blank">Registered Designs Act 1949</a> and the <a href="https://www.legislation.gov.uk/ukpga/1997/66/contents" target="_blank">Plant Varieties Act 1997</a> have been amended to provide for such rights. Applicants for EU trade marks and registered Community designs which were not determined before 31 Dec 2020 have an additional period of 9 months to apply for a UK trade mark or registered design offering the same protection.</div><div style="margin-bottom: 5px;"><br />One very important change that occurred on 31 Dec 2020 is that courts in the United Kingdom are no longer EU trade mark or Community design courts. Actions for infringement of EU trade marks, Community designs or Community plant varieties have to be brought in an EU member state such as the Republic of Ireland, As one of my colleagues in chambers is a senior counsel of the Irish bar (the equivalent of a QC) who qualified as a trade mark attorney before reading for the Irish and English bars, my chambers can continue to represent British holders of EU trade marks and Community designs in the EU. <br /><br />i discussed these and other matters in my presentation to the Barnsley Business Village on 19 Feb 2021, Earlier on Friday, I had been invited by Helen Wong to update my contribution to her book, <i><a href="https://www.bloomsburyprofessional.com/uk/doing-business-after-brexit-9781784519360/" target="_blank">Doing Business After Brexit A Practical Guide to the Legal Changes</a>, </i>which she first published in 2017. I was introduced by <a href="https://www.linkedin.com/in/steve-ding-748396/" target="_blank">Steve Ding</a> who is Head of Global Talent at Webanywhere. I have known Steve for many years. When I first made his acquaintance, he was Chief Executive of Bmedi@.<div><br /></div><div>Bmedi@ was the forum for much of the creative sector in West Yorkshire and later West and South Yorkshire. It had a very diverse membership ranging from brand consultants to web designers. It included some of the brightest, most enterprising and talented individuals I have ever met. Bmedi@ offered a wide range of services but the high points for me were the Third Thursday meetings at the Bradford Business and Innovation Centre with speakers from business, government and the universities on everything from 3D printing to Web 2.0. Later Bmedi@ held monthly breakfast meetings at Barnsley Business and Innovation Centres at Wilthorpe and Cudworth and at the Digital Media Centre in Barnsley town centre, </div><div><br /></div><div>Although Bradford is overshadowed to a certain extent by Leeds it has a lot going for it. Its university offered one of the first computer science degree courses in the United Kingdom and its School of Management is one of the country's oldest business schools. The <a href="https://www.scienceandmediamuseum.org.uk/" target="_blank">National Science and Media Museum</a> is linked to the Science Museum in London, the Museum of Science and Industry in Manchester and the National Railway Museum in York. It has a very young population and many of its residents have come from outside the UK. Some of them have founded businesses which have become household names around the world.</div><div><br /></div><div>Third Thursday worked well because the discussions took place over wine, pizza and Bombay mix. Obviously, we could not do any of that online but the platform has a breakout facility called the "exhibition hall" which is the next best thing. Each breakout space (called a "table") has space for up to 4 occupants. I went to the nearest table and was joined by Steve Ding, <a href="https://www.linkedin.com/in/alison-orr-7292292/" target="_blank">Alison Orr</a> of <a href="https://www.inngot.com/" target="_blank">Inngot</a> and <a href="https://www.linkedin.com/in/robincramp/" target="_blank">Robin Cramp</a> of the <a href="https://screen-network.org.uk/" target="_blank">Screen Industry Growth Network</a>.<br /></div><div><br /></div><div>In our brief conversation, Steve outlined his hopes for the network. Bmedi@ disbanded in 2011. It is still missed by many of its members. With the economy in deep recession, the need for the services that Bmedi@ used to offer has never been greater. Though it will be necessary to hold online meetings for the next few weeks Steve hopes eventually to have live meetings in a lecture room with pizza, wine and Bombay mix. I am very happy to help make that happen.<br /><br />Among the services that Bmedi@ offered were patent clinics in Bradford and Barnsley, I have never stopped holding monthly clinics on the second Tuesday of every month at the Barnsley Business Village in Wilthorpe. I should be very happy to revive the Bradford clinic. Having held its first meeting, the BradfrodNetwork needs to announce a second in the next few days. I have been holding monthly IP clinics in Yorkshire since 2004. I have therefore experienced the economic downturn which resulted from the banking crisis, the slow recovery, and the 20.4% slump in GDP which the Office for National Statistics announced yesterday (see <i><a href="https://www.ons.gov.uk/economy/grossdomesticproductgdp/bulletins/gdpmonthlyestimateuk/april2020" target="_blank">GDP monthly estimate, UK: April 2020,</a></i> 12 June 2020 ONS). I have found attendance at my monthly <a href="https://ipyorkshire.blogspot.com/2017/11/initial-advice-and-signposting.html" target="_blank">IP clinic in Barnsley</a> to be a pretty good bellwether of the state of the economy.<br />

This week for the first time in months I had three enquiries. As I explained in <i><a href="http://ipyorkshire.blogspot.com/2020/04/by-badics-own-work-cc-by-sa-3.html" target="_blank">Barnsley IP Clinic 14 April 2020</a> </i>I have had to offer these clinics online. That enables me to see clients at a mutually convenient rather than a two-hour session at the <a href="https://www.barnsleybic.co.uk/about-the-business-village/wilthorpe/" target="_blank">Business Village</a> in Wilthorpe. I also hold a similar clinic at the Menai Science Park in Anglesey which is now online (see <i><a href="https://nipcwales.blogspot.com/2020/04/online-support-for-businesses-in-wales.html" target="_blank">Online Support for Businesses in Wales</a> </i>13 April 2020 NIPC Wales). However, until this week I had received only one enquiry and that came from North Wales),<br />

What is encouraging about this week's enquiries is that they were all about new business ventures. Obviously, I can't disclose who they were or anything about their businesses but they were interested in legal protection for their brands and technology. The conversations on branding led to trade marks and the discussion on protecting technology led to patents and alternatives to patents. I also mentioned trade mark and patent searches and how to obtain them, clinics at the Sheffield and Leeds Business and IP Centres run by CIPA and others, and how and where to find a patent or trade mark attorney.<br />

All three clients were enthusiastic and motivated. They were aware that they were going into business at a very bad time but they had researched their markets and were sure that their businesses would grow as the economy revives. Now I may be wrong about this but I think they will succeed. I also think there are others like them from the Shetlands to the Scillies. A flash in the pan? Perhaps! But I think they are straws in the wind. I say that because something very similar happened in about 2011 and 2012. There were dips of inactivity now and then but as the economy picked up so dud attendances at my clinic.<br />

Now for a tip. At my clinics and inventors' clubs, I am often asked about T & C. These are about managing risk which is why terms and conditions designed for one business may not necessarily suit another. They are meant to dovetail with following best practice and public liability and other insurance. <br />
<br />
Just outside Wakefield, there stand the ruins of a medieval castle which was also about managing risk. There was a moat to keep out wild animals, sturdy vagabonds, and other undesirables. That was enough to deter most threats to the castle and its inhabitants. To fight off besieging armies there was a curtain wall from which defenders could fire arrows and pour boiling all or molten lead on their attackers. If the wall was breached, there was a keep with thick walls where the defenders made their last stand as Macbeth tried to do against Macduff.<br />

Terms and conditions are the last line of defence. Contract terms cannot be used to exclude certain types of liability. The first line of defence is best practice. That equates to the moat. The second line is insurance. That is like the curtain wall. Terms and conditions can sometimes be used to regulate risks that cannot be insured against and where best practice fails. They should, therefore, be drafted with the needs of the business in mind with the insurance policy and manual if best practice to hand.<br />

On the second Tuesday of every month, I hold an intellectual property clinic at <a href="https://www.barnsleybic.co.uk/" target="_blank">Barnsley Business and Innovation Centre</a> at Wilthorpe between 16:00 and 18:00. The next one is due to take place on Tuesday, 14 April 2020. Obviously, I can't visit the Centre and neither can those who require advice but there is no reason why the clinic cannot be conducted by phone or video link.<br />

As I said in <i><a href="https://nipcinvention.blogspot.com/2020/03/ip-services-during-emergency.html?m=0" target="_blank">IP Services during the Emergency</a> </i>23 March 2020 NIPC Inventors Club, IP is now more important than ever:<br />

"If we are ever to stop Covid-19 in its tracks it will be through the efforts of universities and biotech and pharmaceutical companies around the world whose research will have to be funded. Much of that funding will come from the private sector which will require legal protection for the revenue streams from which it will recoup such investment."</blockquote>
Very much the same is true of the design and development of medical devices, personal protection equipment, infection tracking and logistics software and all the other contributions that will be required to counter the menace.<br />

Much of that work will be done by small businesses and in some cases individuals. As I also said in the article, those businesses will need the best possible advice on patenting, licensing and technology transfer too and they will need them on affordable terms. <a href="https://www.judiciary.uk/publications/mr-justice-birss/" target="_blank">Mr Justice Birss</a> was the guest of honour at <a href="https://ipyorkshire.blogspot.com/2018/12/tipsy.html" target="_blank">The Intellectual Property Society of Yorkshire ("TIPSY") </a>dinner at the DoubleTree by Hilton hotel at Granary Wharf in Leeds on 27 Feb 2020. Once again it was organized by <a href="https://www.linkedin.com/in/andrew-clay-8915282/" target="_blank">Mr Andrew Clay</a>, a solicitor specializing in intellectual property law in Harrogate. The meal with its choice of three dishes for each course was excellent. I chose soup, salmon and crumble together with white and red wine, mineral water and coffee.<br />

After dinner, Dick Waddington pf Appleyard Leeds introduced our guest and invited him to speak on the <i>Assessment of Damages for IP Infringements. </i>Disarmingly the judge acknowledged that he had not chosen the most riveting topic for an after-dinner speech. Having said that, his talk was as interesting and entertaining as any on the subject. The only hissing he received was when he mentioned his Scottish birth and Lancastrian education. He had contemplated (but then thought better of) appearing in his old school tie which included red roses in its design. However, he revealed a Yorkshire connection in that his mother had moved to Ilkley.<br />
<br />
The speaker began with a reminder that intellectual property infringement was a tort and that an award of damages in tort was supposed to put the injured party in the position he or she would have been had the wrong not been committed. Easy to say but not always easy to apply. There were two qualifications to that rule<br />
<ul>
<li>An account of profits which is restitutionary or perhaps fiduciary in nature is available as an alternative to damages; and</li>
<li>Damages for the misuse of confidential information is a remedy for a breach of an equitable duty rather than compensation for a tort.</li>
</ul>

Mr Justiice Birss reminded his audience of the House of Lords' decision in <i>General Tire and Rubber Company v Firestone Tyre and Rubber Company Ltd</i> [1976] RPC 197, [1975] 1 WLR 819, [1975] 2 All ER 173, [1975] FSR 273 which considered different ways of assessing damages. One way was to calculate the loss of sales. Another was to compute the royalties that would be agreed by a willing licensor and a willing licensee bargaining at arms' length, There were however difficulties with both approaches. Litigants were very different from parties wanting to do business with each other and there are circumstances when a claimant would have incurred losses from sales of a non-infringing item even if there had been no infringement.<br />

The judge discussed such cases as <i>Wrotham Park v Parkside Homes </i> [1974] 1 WLR 798 and <i><a href="https://www.bailii.org/uk/cases/UKHL/2000/45.html" target="_blank">Attorney General v Blake</a></i> [2001] Emp LR 329, [2000] EMLR 949, [2000] UKHL 45, [2001] 1 AC 268, [2000] 4 All ER 385, [2000] 3 WLR 625, [2001] IRLR 36, [2000] 2 All ER (Comm) 487, [2001] AC 268, [2001] IRLR 37 where the object was to impose a cost on the defendant for breaching a restrictive covenant or a duty of confidence rather than delivering compensation. He also considered <i><a href="https://www.bailii.org/uk/cases/UKSC/2018/20.html" target="_blank"> Morris-Garner & Anor v One Step (Support) Ltd</a>.</i> [2019] AC 649, [2018] WLR(D) 260, [2018] 3 All ER 659, [2018] 1 Lloyd's Rep 495, [2018] UKSC 20, [2018] 2 All ER (Comm) 769, [2018] IRLR 661, [2018] 2 WLR 1353.</div>

Points that the judge mentioned briefly included alternative ways of computing FRAND royalties - extrapolation or comparables - the right of a successful claimant to request disclosure of a defendant's sales so that he can make an educated choice as to damages or an account of profits, assessing damages liberally and the innumeracy of many lawyers. Only at the very end did the judge mention the Enforcement Directive and then only in passing.<br />
<br />
Mr Justice Birss reminded the audience that small claims track IP cases could now be brought in Leeds and other major cities outside London and he urged his audience to use them. If there was demand for IP litigation outside London the courts would arrange for multitrack cases to be heard there. In the Q and A that followed, one questioner asked about punitive damages in IP, another mentioned a rumour that the UK planned to withdraw from the Unified Patent Court agreement while Mr Clay speculated on a claim for a battleship fitted with a tine whistle. I raised my hand and gesticulated wildly but Dick Waddington did not see me.<br />

On the second Tuesday of every month between 16:00 and 18:00, I hold up to 4 free consultations of 30 minutes each with entrepreneurs, inventors and other creative people who require advice or assistance on IP law.<br />

Enquiries can be of any kind. For instance, an inventor of a new product may want to know whether it is patentable. I can't give him or her a complete answer in 30 minutes but I can tell the inventor the basic principles of patent law, advise about searches, how and where to apply, the likely costs in the Intellectual Property Office and European Patent Office and applications under the Patent Cooperation Treaty, the advantages of instructing a patent attorney and how they can be found and free or cost-effective business services through the Business and IP Centres at Leeds and Sheffield.<br />

Sometimes the client needs services from another professional such as a product design consultant or a specialist insurance broker. I can help point him or her in the right direction, I have been running this clinic for the last 12 years and I have built up an enormous list of contacts in Yorkshire and beyond over that time.<br />

On Monday I delivered the above presentation at Barnsley's splendid new library at <a href="https://www.barnsley.gov.uk/services/libraries/find-a-library/library-at-the-lightbox/" target="_blank">The Lightbox</a>. The library is one of many facilities at a new shopping and entertainment complex known as <i><a href="https://theglassworksbarnsley.com/" target="_blank">The Glassworks</a>. </i>I gave my talk in the meeting room that appears below. The gist of my presentation can be gleaned from my slides. <br />
<br />
Whenever I give a talk like this I stress the difference between <a href="http://nipclaw.blogspot.com/p/intellectual-property.html" target="_blank">intellectual property</a> which is the collective name for a bundle of laws and the brands, designs, technology and creative works that those laws protect, namely <a href="http://nipclaw.blogspot.com/p/what-are-intellectual-assets.html" target="_blank">intellectual assets.</a> Too often the term intellectual property is used interchangeably for the legal protection and the subject of that protection, namely the inventions, books or distinctive signs. I also stress that there are nearly always alternative ways of protecting an asset. For instance, an inventor can keep his invention under wraps until he is ready to exploit it (and even longer if it cannot easily be reverse-engineered) or he can disclose it to the world in exchange for a patent. There are advantages and disadvantages of patent and trade secret protection.<br />
<br />
I discuss the rights that require registration such as patents, trade marks, registered designs and plant breeders' rights and those that come into being automatically such as copyright, design right, rights in performances and the common right actions of breach of confidence and passing off. As a lot of businesspeople have never heard of patent or trade mark agents or are not quite sure what they do, I explained the roles of each of the main IP professions, that is to say, patent and trade mark attorneys and specialist solicitors and counsel, how they are regulated and where they can be identified and instructed.<br />
<br />
I continued my talk with a discussion of assignments, licensing and franchising. I explained the difference between exclusive, sole and non-exclusive licences. I spoke about IP strategy and suggested a simple one for a new business with limited funds.<br />
<br />
I also mentioned enforcement. I told them that an intellectual property right can be regarded as a right to bring a lawsuit and that it is ultimately useless if it cannot be enforced. That will cost money and I considered IP insurance and other funding mechanisms. I discussed some options such as the Intellectual Property Enterprise Court and its small claims track and some of the alternatives to litigation such as proceedings before hearing officers in the IPO, mediation, examiners' opinions on the validity and infringement of patents and the Uniform Domain Name Dispute Resolution Policy and Nominet's Dispute Resolution Service.<br />

Finally, I mentioned my monthly pro bono clinics at rhw Business Village (formerly Barnsley Business and Innovation Centre) at Wilthorpe on the second Tuesday of every month (see <i>I<a href="https://ipyorkshire.blogspot.com/2018/08/ip-yorkshire-clinics.html" target="_blank">P Yorkshire Clinics</a> </i>17 Aug 2018). I also recommended the services provided by the Business and IP Centres at Sheffield and Leeds Central Libraries.<br />

I was asked a number of questions such as the significance of the © and ® signs and whether they were necessary for the subsistence of copyright or a registered trade mark. I was also asked about the "TM" sign and I quipped that the former librarian at Manchester Central Library had said that the sign stood for "totally meaningless". I said I wouldn't go quite that far and that it might warn of an intention to sue for passing off. My audience was quite surprised to learn some statistics such as the number of European Patents that are sought from this country in comparison with other large industrial countries and the massive number of patent applications from China, Japan and South Korea. We had a very lively Q & A which might have continued for some time had the library staff not enquired whether we had homes to go to.<br />

On branding, I will cover not only registered trade marks and passing off but less obvious protection such as database rights in market research and customer service records which is the basis of a business's goodwill.<br />

On design, I will discuss both decorative design which is protected by design registration and in some cases copyright but also functional design which is covered by unregistered design right and sometimes semiconductor topographies.<br />
<br />
On technology, I will mention not only patents but also trade secrets (including the new Directive), unregistered design rights, copyright and database right for programs and data, unregistered design rights and plant varieties.<br />
<br />
In relation to creativity, I will talk about copyright and rights in performances.<br />
<br />
On enforcement, I will consider litigation options (the Patents Court, Intellectual Property Enterprise Court multitrack and small claims track, the IPO's tribunals. the Chancery Division and County Court) and alternatives to litigation such as ICANN's UDRP and Nominet's DRS for domain name disputes, IPO examiners opinions on the validity or infringement of patents and mediation).<br />

One of the most interesting announcements of the new <i>Intellectual Property Enterprise Court Guide </i>is the decision to appoint from October 2019 district judges to hear small intellectual property claims in Leeds (see <i><a href="https://nipcnews.blogspot.com/2019/07/the-new-ipec-guide.html" target="_blank">The New IPEC Guide</a> </i>4 July 2019 NIPC News).<br />

The cases that those district judges will be entitled to hear pursuant to <a href="https://www.justice.gov.uk/courts/procedure-rules/civil/rules/part63#63.27" target="_blank">CPR 63.27</a> will be claims for £10,000 or less for the infringement of <a href="http://nipclaw.blogspot.com/p/intellectual-property.html" target="_blank">intellectual property rights</a> other than <a href="http://nipclaw.blogspot.com/p/what-is-patent.html" target="_blank">patents</a>, <a href="http://nipclaw.blogspot.com/p/registered-designs.html" target="_blank">registered</a> and <a href="http://nipclaw.blogspot.com/p/registered-community-design.html" target="_blank">registered Community designs</a>, <a href="http://nipclaw.blogspot.com/p/unregistered-design-right.html" target="_blank">semiconductor topographies</a> and <a href="http://nipclaw.blogspot.com/p/plant-breeders-rights.html" target="_blank">plant varieties</a>. The claimant must ask for the claim to be allocated to the small claims track in its particulars of claim and no objection should be raised by the defendant. However, even if a case falls within the jurisdiction of the small claims track and the parties want it to stay there, the court may transfer it to the multitrack if it is likely to take more than a day to try or there is a difficult point of law or factual issue to decide.<br />
<br />
Proceedings in the small claims track are governed by <a href="https://www.justice.gov.uk/courts/procedure-rules/civil/rules/part27" target="_blank">CPR Part 27</a> and the <a href="https://www.justice.gov.uk/courts/procedure-rules/civil/rules/part27/pd_part27" target="_blank">Part 27 Practice Direction</a> as modified by <a href="https://www.justice.gov.uk/courts/procedure-rules/civil/rules/part63#63.27" target="_blank">CPR 63.27</a> and <a href="https://www.justice.gov.uk/courts/procedure-rules/civil/rules/part63#63.28" target="_blank">CPR 63.28</a> and <a href="https://www.justice.gov.uk/courts/procedure-rules/civil/rules/part63/pd_part63#32.1" target="_blank">paragraph 63.32</a> of the Part 63 Practice Direction. Though successful claimants can obtain final injunctions and orders for delivery up of infringing materials as well as damages or accountable profits they cannot claim interim injunctions. Liability and the amount of any damages or other pecuniary relief to be awarded are decided at the same time. Directions are given automatically in accordance with <a href="https://www.justice.gov.uk/courts/procedure-rules/civil/rules/part27/pd_part27#B" target="_blank">Appendix B</a> or <a href="https://www.justice.gov.uk/courts/procedure-rules/civil/rules/part27/pd_part27#C" target="_blank">C </a>of the Part 27 Practice Direction after statements of case are exchanged and although the court has power under <a href="https://www.justice.gov.uk/courts/procedure-rules/civil/rules/part27#27.6" target="_blank">CPR 27.6</a> to hold preliminary hearings these are the exception rather than the rule. There is no provision for disclosure and the costs that may be recovered from an unsuccessful party are limited to court fees, £260 if an injunction is sought and a lawyer has been instructed, travelling expenses and loss of earnings up to £95 per witness and up to £750 in experts' fees.<br />

The new IPEC guide indicates that those wishing to bring an IP case in the small claims track in Leeds should use the electronic filing system.<br />

One of four things has to happen between now and the 29 of this month:<br />
<ul>
<li>The withdrawal agreement that <a href="https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX%3A12012M050" target="_blank">art 50 (2) of the Treaty on European European Union</a> required the EU and UK to negotiate and conclude may be approved by Parliament in which case we shall leave the EU on the 29 but EU law will remain in force until 31 Dec 2020 at the earliest;</li>
<li>The Prime Ministers notice of intention to leave the EU may be revoked in which case everything will remain the same forever;</li>
<li>The UK and remaining EU member states may agree to extend the 2-year notice period in accordance with art 50 (3) in which case everything will remain the same as it is now until the end of that further period; or</li>
<li>Nothing may be done between now and the 29 of this month in which case the UK will leave the EU at 23:00 on the 29 and EU law will cease to apply.</li>
</ul>
We shall not learn which of those four will happen until 12 March at the earliest and perhaps not even then if the withdrawal agreement is voted down again.<br />
<br />
My presentation to Sheffield Business and IP Centre at Sheffield Central Library on 6 March 2019 considered the consequences for IP of each of the four scenarios. It analysed the IP provisions of the draft withdrawal agreement which will be implemented under draft secondary legislation pursuant to the <a href="http://www.legislation.gov.uk/ukpga/2018/16/contents/enacted" target="_blank">European Union (Withdrawal) Act 2018</a> from midnight on 1 Jan 2021 at the latest if that agreement is approved by Parliament. Such secondary legislation will come into effect at 23:00 on 29 March 2019 if the UK leaves the EU without a withdrawal agreement. The legislation will not be needed at all if the 2017 notice is revoked. Its implementation will be delayed until at least the end of the extension period if the 2-year notice is extended.<br />
<br />
The presentation considers the future of the Unified Patent Court and the unitary patent. If the 2017 notice is revoked the UPC Agreement could come into force with continued British participation so long as a challenge to the constitutionality of German certification in the German Constitutional Court is defeated. If the notice period is extended or a withdrawal agreement is approved by Parliament continued British participation may be possible. It is highly unlikely if the EU leaves without an agreement.<br />
<br />
The draft secondary legislation provides for the conversion of EU trade marks and Community designs and plant varieties into corresponding national rights. EU legislation on supplemental protection certificates and compulsory licences will be incorporated into national law. But the Brussels Regulation and Lugano Convention could fall away without a withdrawal agreement and English and Welsh, Scottish and Northern Irish courts will lose the right to seek preliminary rulings on the interpretation of EU law from the Court of Justice of the European Union.<br />

Because <a href="http://nipclaw.blogspot.com/p/intellectual-property.html" target="_blank">intellectual property</a> protects investment in branding, design, technology and creative output, any change in the nature and extent of the legal protection is likely to impact on the businesses that rely on such protection. Since <a href="http://nipclaw.blogspot.com/p/eu-trade-marks.html" target="_blank">EU trade marks</a>, <a href="http://nipclaw.blogspot.com/p/registered-community-design.html" target="_blank">registered</a> and <a href="http://nipclaw.blogspot.com/p/unregistered.html" target="_blank">unregistered Community designs</a>, <a href="http://nipc-branding.blogspot.com/p/geographical-indications.html" target="_blank">geographical indications</a> and <a href="http://nipclaw.blogspot.com/p/plant-breeders-rights.html" target="_blank">Community plant variety rights</a> will cease to apply to the UK upon its departure from the EU, Brexit will have a substantial impact on all those businesses.<br />
<br />
For that reason, I have been writing and speaking about the consequences of Brexit even before the 2016 referendum (see<i><a href="http://nipclaw.blogspot.com/2016/02/were-we-to-go-what-would-brexit-mean.html" target="_blank"> Were we to go - what would Brexit mean for IP?</a> </i>26 Feb 2016 NIPC Law). I contributed the chapter on IP to Helen Tse's <i><a href="https://www.bloomsburyprofessional.com/uk/doing-business-after-brexit-9781784519360/" target="_blank">Doing Business after Brexit</a>, </i>I have spoken about the topic at leading law schools (see <i><a href="https://nipcnews.blogspot.com/2018/01/implications-of-brexit-on-intellectual.html" target="_blank">Implications of Brexit on IP Law</a> </i>19 Jan 2018). I have followed each and every turn of the Brexit negotiations in my <i><a href="http://nipcexit.blogspot.com/" target="_blank">Brexit blog</a> </i>in order to advise my clients accurately and comprehensively (see<i><a href="http://nipclaw.blogspot.com/2018/07/brexit-why-do-i-follow-art-50-2.html" target="_blank"> Brexit - Why do I follow the Art 50 (2) Negotiations when I am an IP Lawyer?</a> </i>26 July 2018).<br />

It might be thought that everything that can be said about IP and Brexit has been said but, unfortunately, that is not the case. Unless the<a href="https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/604079/Prime_Ministers_letter_to_European_Council_President_Donald_Tusk.pdf" target="_blank"> notification that the Prime Minister gave to the President of the Council on 29 March 2017</a> is revoked or the notice period is extended before the 29 March 2019 the UK leaves the EU at 23:00 on that day. The impact of this country's departure on business will depend on whether the country leaves on that date and, if it does, on whether it leaves with or without a withdrawal agreement. As I noted in my latest <i><a href="http://nipcexit.blogspot.com/2019/02/brexit-briefing-january-2019.html" target="_blank">Brexit Briefing</a> </i>we still have no idea of the terms or even the effective date of our departure.<br />
<br />
Ever since the withdrawal agreement negotiations began I have advised businesses to prepare for all eventualities including a no deal Brexit. I have advised them to review their patent, trade mark and design registration portfolios and apply for national or as the case may be EU registrations to fill possible gaps in their legal protection, I have advised them to read their licences, franchise, joint venture and other agreements and to draft or negotiate contract terms to fill any lacuna. It may be too late to do some of those things but there is still much that businesses can do.<br />
<br />
My talk will list all the issues businesses will encounter when protecting their brands, designs, technology or creative output and the possible countermeasures. By the end of my talk business owners and managers will have a much better idea of possible risks (and maybe even a few opportunities) and the steps they should take.<br />
